I. LOCATION AND FUNCTION

Article 1. Location

 The Economic Department is a specialized agency under the People's Committee of Hoa My commune; performs the function of advising and assisting the People's Committee of the commune in state management of the local industry and field according to the provisions of law; has legal status and a seal; is subject to the direction and management of the organization, job positions, civil servant payroll, civil servant rank structure and work of the People's Committee of the commune; at the same time is subject to the direction, inspection and guidance on expertise and profession of the Departments under the Provincial People's Committee.

Article 2. Functions

The Economic Department  has the function of  advising and assisting the People's Committee of the commune in performing state management functions in the following areas:

1. Financial - Planning field, including:  Finance - State budget; planning and investment; statistics; registration of business households, cooperatives, cooperative unions; support for enterprises and collective economic organizations;

2. Construction and Industry and Trade sector, including:  Construction planning, architecture; construction investment activities;  (including: water supply; construction material production facilities; cemetery management) ; housing; offices; construction materials; transportation; small-scale industry; industry; commerce;

3. Agriculture and Environment sector, including:  Land; water resources; mineral resources; environment; agriculture; forestry; irrigation; fisheries; rural development; natural disaster prevention and control; poverty reduction; quality and food safety of agricultural, forestry and fishery products; development of household economy, rural farm economy, collective economy, agriculture, forestry and industry associated with rural occupations and craft villages.

II. DUTIES AND POWERS

Article 3.  Finance and Planning Sector

1. In the field of finance and budget

1.1. Submit to the Commune People's Committee:

- Draft Resolution of the People's Council of the commune (if any), draft decision of the People's Committee of the commune related to the sector, field of Finance - Planning and other documents as assigned by the People's Committee of the commune.

- Draft program plans and measures to organize the implementation of industry development tasks, industry development fields, and Finance - Planning fields at the commune level.

1.2.  Organize the implementation of legal documents, planning, and plans after approval; provide information, propaganda, dissemination, legal education, and monitor law enforcement in the field of Finance - Planning in the commune.

1.3.  Guide the agencies and budget units of the commune to develop annual budget estimates, synthesize and submit to the Commune People's Committee according to regulations.

1.4.  The Economic Department is the focal point for synthesizing and preparing the commune budget estimate, the commune budget allocation plan, and the commune budget adjustment estimate when necessary, and submits it to the Commune People's Committee; and organizes the implementation of the decided budget estimate.

1.5.  Appraisal of financial settlement for units, organizations and individuals according to the provisions of the law on state budget.

1.6.  Prepare, appraise and synthesize public investment plans within the scope of assigned tasks and capital sources under the management of the Commune People's Committee; synthesize and advise on extending the capital arrangement period, extending the implementation period and disbursing capital under the decentralized management; appraise contractor selection plans for projects decided for investment by the Chairman of the Commune People's Committee; appraise interest invitation documents, pre-qualification invitation documents, bidding documents, request documents, results of evaluation of interest documents, pre-qualification application documents, contractor selection results for bidding packages under projects invested by the Commune People's Committee.

1.7.  Preside over the organization of the appraisal of the final settlement of investment capital for completed projects under the budget managed by the People's Committee of the commune; synthesize and prepare reports on the final settlement of budget revenue in the commune and the final settlement of revenue and expenditure of the commune-level budget to report to the People's Committee of the commune for submission to the competent authority for approval.

1.8.  Advise and assist the People's Committee of the commune in preparing statistical tables, organizing statistical surveys according to the provisions of the law on statistics; synthesizing, compiling statistics and managing databases in various fields in the area (including databases on commune-level cadres, civil servants and part-time workers in the commune and village).

1.9.  On private enterprises, collective economy, and business households

a) Receive registration dossiers for cooperative groups, cooperatives, cooperative unions, and business households; grant or refuse to grant registration for cooperative groups, cooperatives, cooperative unions, and business households; guide cooperative organizations, cooperatives, cooperative unions, and founders of cooperative groups, cooperatives, cooperative unions, and business households on dossiers, procedures, and order for registration of cooperative groups, cooperatives, cooperative unions, and business households as assigned by the People's Committee of the commune;

b) Coordinate the construction, management and operation of the information system on cooperatives, cooperative unions, and business households in the commune; periodically report to the People's Committee of the commune, the provincial Business Registration Office, and the local tax authority on the registration of cooperatives and business households in the commune; provide information on registration of cooperatives, cooperatives, cooperative unions, and business households in the locality to organizations and individuals upon request in accordance with the provisions of law;

c) Implement contents, projects, programs, and plans to support the development of private enterprises and business households in the area according to assigned authority and budget; synthesize, monitor, and evaluate the implementation of programs, plans, projects, mechanisms, and policies for the development of private enterprises, collective economy, and business households in the commune;

d) Directly inspect, monitor or request competent state agencies to inspect and monitor cooperatives, cooperatives, cooperative unions, and business households according to the contents of the registration dossiers of cooperatives, cooperatives, cooperative unions, and business households within the locality; handle violations of business registration, revoke and restore the Certificate of registration of cooperatives, business households, cooperatives, and cooperative unions; Certificate of registration of branches and representative offices; dissolve and terminate the operation of cooperatives, business households, cooperatives, cooperative unions, branches, representative offices, and business locations according to the provisions of law.

1.10.  Manage public assets at agencies, organizations, and units under the management of the commune level according to the provisions of law on management and use of public assets and decentralization of competent agencies. Appraise and give opinions on tasks considered and decided by competent agencies and individuals under the People's Committee of the commune according to the provisions of law on management and use of public assets; organize the implementation of decisions on the formation, use, and disposal of public assets assigned by competent agencies and individuals under the People's Committee of the commune according to the provisions of law on management and use of public assets. Be the owner of the temporary account to manage the amount of money collected from handling and exploiting public assets according to the provisions of law.

1.11.  Advise the Commune People's Committee to perform state management of prices and price appraisal according to the assignment and decentralization of the Provincial People's Committee; advise the Commune People's Committee to organize price stabilization in the area, State pricing work, receive declarations of prices of goods and services, deploy activities of synthesizing, analyzing, forecasting market prices, updating information, keeping data in the price database, organizing State price appraisal activities and other state management tasks on prices according to the assignment and decentralization of the Provincial People's Committee.

1.12. On bidding management

a) Advise the People's Committee of the commune to carry out bidding activities for bid packages and projects in which the People's Committee of the commune is the investor and the competent person;

b) Advise the People's Committee of the commune to carry out bidding activities for bid packages and projects in the area or perform assigned tasks for projects of the People's Committee of the commune, the Chairman of the People's Committee of the commune is authorized in bidding to select investors;

c) Advise the People's Committee of the commune to carry out investment activities under the public-private partnership method or perform tasks authorized by the People's Committee of the commune or the Chairman of the People's Committee of the commune in investment activities under the public-private partnership method.

1.13  Coordinate with relevant agencies in managing state budget collection in the area according to the provisions of law.

1.14.  Manage authorized funding sources from superiors; manage financial services according to the provisions of law.

1.15.  Guide and inspect the management of finance, budget, prices, and implementation of accounting regimes of state agencies, administrative units, and public service units at the commune level; synthesize and report on the implementation of assigned tasks to the Commune People's Committee and the Department of Finance.

1.16.  Deploy applications of scientific and technological advances; participate in the use and exploitation of national information systems and databases according to system decentralization; build information and storage systems to serve financial management and assigned professional expertise.

1.17.  Implement the periodic and ad hoc reporting regime on finance, budget, investment, and market prices to the Department of Finance as prescribed.

1.18.  Preside over and coordinate with relevant agencies and units to guide and inspect the implementation of the law on Finance - Planning; assist the People's Committees at the commune level in resolving disputes, complaints and denunciations in the field of Finance - Planning according to the provisions of law.

1.19.  Manage cadres, civil servants, finances and assets assigned according to the provisions of law and the assignment of the People's Committee of the commune.

1.20.  Perform other tasks of state management in the field of Finance - Planning according to decentralization, authorization, and authority regulations as prescribed by law and assigned by the People's Committee at the commune level.

Article 4. Construction sector

1. Submit to the Commune People's Committee:

a) Draft resolutions of the People's Council of the commune, draft decisions of the People's Committee of the commune related to the construction field under the management of the Department and other documents assigned by the People's Committee of the commune;

b) Draft plan for construction sector development; program and measures to organize the implementation of construction tasks in the commune within the management scope of the Department;

c) Draft decisions on planning and medium-term and annual development plans; programs and measures to organize the implementation of state administrative reform tasks in the construction sector and field; draft documents regulating the functions, tasks, powers and organizational structure of the Department;

d) Draft decision specifying the functions, tasks, powers and organizational structure of the Department;

d) Draft programs and solutions for mobilization and inter-sectoral coordination in ensuring traffic order and safety in the area;

e) Investment projects to build infrastructure in the area according to the provisions of law and the assignment and decentralization of the People's Committee of the commune;

g) Draft decision on road and commune road classification according to law provisions;

2. Submit to the Chairman of the People's Committee of the commune draft documents under the authority of the Chairman of the People's Committee of the commune as assigned.

3.  Organize the implementation of legal documents, planning, and plans after approval; provide information, propaganda, dissemination, and legal education on construction fields within the assigned management scope; monitor law enforcement.

4.  Advise the People's Committee of the commune in organizing the implementation of tasks in the following fields: Urban and rural planning; architecture; construction investment activities; urban development; technical infrastructure; housing; offices; construction materials in the area according to the provisions of law and the assignment and decentralization of the Provincial People's Committee.

5.  Advise and assist the People's Committee of the commune in establishing architectural management regulations according to the assignment, decentralization and authorization of the People's Committee of the province and commune.

6.  Assist the People's Committee of the commune in implementing and taking responsibility for the appraisal, registration, issuance of licenses, and approval of construction sites within the scope of responsibility and authority of the Department according to the provisions of law and the assignment of the People's Committee of the commune.

7.  Inspect organizations and individuals in the assigned areas of responsibility in implementing legal regulations; receiving citizens, resolving complaints and denunciations; preventing and combating corruption, waste, and negativity according to legal regulations and assignments of the People's Committee of the commune.

8.  Advise and assist the People's Committee of the commune in the process of establishing, appraising and participating in establishing projects to request recognition of urban types in the area according to regulations (if any).

9.  Advise the People's Committee of the commune to organize the registration of inland waterway vehicles and vehicles serving water recreation;

10.  Organize the preparation, appraisal, and submission to the People's Committee of the commune for approval, or organize the preparation for the People's Committee of the commune to submit to the competent authority for appraisal and approval of rural planning in the area according to the provisions of law.

11.  Advise and assist the Commune People's Committee in organizing the implementation of mechanisms and policies on housing and offices; manage housing funds and the right to manage and use offices in the area according to the decentralization of the Provincial People's Committee; organize the implementation of periodic investigation, statistics and assessment of housing and offices in the area.

12.  Guide and inspect the construction of works according to architectural management regulations, management regulations according to urban planning projects and urban designs approved by competent authorities; organize the announcement and publicization of urban and rural planning; provide information on urban and rural planning; manage boundary markers, construction boundaries, and construction levels in the area according to decentralization.

13.  Organize management, maintenance, and exploitation to ensure technical standards and regulations for the local road and inland waterway traffic network in operation, which the commune is responsible for managing.

14. Manage transportation activities in the area according to the provisions of law and instructions of competent state agencies.

15.  Organize the implementation of measures to prevent, stop and handle acts of encroachment on traffic works and encroachment on traffic safety corridors; coordinate with relevant agencies in clearing encroachment on traffic safety corridors in the area according to the guidance of specialized management agencies, the Department of Construction and the direction of the People's Committee of the commune.

         16.  Coordinate with relevant agencies to carry out search and rescue activities on roads, railways, inland waterways, sea and air occurring in the area.

         17.  Assist the People's Committee of the commune in state management of collective economic organizations, private economic organizations, associations and non-governmental organizations operating in the area under the management of the Department according to the provisions of law.

         18.  Organize the application of scientific and technological advances; build information systems, innovate and digitally transform, and archive to serve the state management and professional work of the Department.

         19.  Carry out the work of entering, updating and adjusting information in the information system and national database on construction activities according to regulations; provide information and periodic and ad hoc reports on the implementation of assigned tasks according to regulations of the Commune People's Committee and the Department of field management.

         20.  Manage and be responsible for the finances and assets of the professional agency according to the provisions of law.

         21. Conduct appraisal of investment construction feasibility study reports, design implementation after basic design of construction investment projects, inspect acceptance of construction works in the area according to the decentralization of the Provincial People's Committee.

        22. Perform other tasks and powers according to the decentralization, authorization, and division of authority of competent authorities as prescribed by law.

        Article 5. On the field of transportation

        1) Submit to the People's Committee of the commune a draft program and solutions for mobilization and inter-sectoral coordination in the implementation of work to ensure traffic order and safety in the area; Draft a decision to classify commune roads according to the provisions of law; Investment projects to build traffic infrastructure in the area according to the provisions of law and the assignment and decentralization of the People's Committee of the provincial level.

        2) Organize the implementation and monitor the enforcement of legal documents, planning, plans, projects, programs and other documents on transportation after being approved by competent authorities.

        3) Organize the management, maintenance, and assurance of technical standards and regulations for the local road traffic network in operation, which is managed by the commune level. Manage transportation activities in the area according to the provisions of law and instructions of competent state agencies.

       4) Organize the implementation of measures to prevent, stop and handle acts of encroachment on traffic works and encroachment on traffic safety corridors; coordinate with relevant agencies in clearing encroachment on traffic safety corridors in the area according to the guidance of specialized management agencies, the Department of Transport and the direction of the People's Committee of the commune.

        Article 6. On the field of industry and trade

        1. Submit to the People's Committee of the commune: Draft resolutions of the People's Council of the commune, draft decisions of the People's Committee of the commune related to the industry and trade sector under the management of the department; programs and measures to organize the implementation of state administrative reform tasks in the industry and trade sector.

        2. Submit to the Chairman of the People's Committee of the commune; draft decisions and other documents under the authority of the Chairman of the People's Committee of the commune as assigned.

        3. Organize, guide and implement policies to encourage collective economic organizations and private economic organizations to invest in industrial and commercial development, expand production, business and circulation of goods in the area; organize technology transfer consulting services, provide information, promote trade and train human resources for production and business establishments in the assigned management fields. Implement programs and plans to promote trade, build and develop brands in the area as assigned by competent authorities.

       4. Advise the People's Committee of the commune to perform state management of industrial clusters in the area according to Government regulations on management and development of industrial clusters and other relevant laws.

       Advise the People's Committee of the commune to organize the implementation of tasks to support the development of small and medium enterprises in the fields of industry and handicrafts; organize activities to develop small industries, industrial and handicraft villages in the area according to the provisions of law.

        5. Preside over and advise the Commune People's Committee on developing and submitting for promulgation an industrial promotion plan in accordance with legal regulations and local conditions; advise competent authorities to ensure funding from the local budget to organize industrial promotion in the area.

        6. Advise the People's Committee of the commune in implementing state management on consumer rights protection according to the provisions of law.

         7. Advise the People's Committee of the commune to perform state management of chemicals, industrial explosives, and food safety according to the provisions of law and according to the assignment, decentralization, or authorization of competent authorities.

         8. Disseminate regulations on electricity prices for students and workers renting houses for accommodation; conduct inspections, monitor and periodically report on the implementation of retail electricity prices at rental locations within the management area according to regulations and handle violations according to the law.

        9. Organize the implementation of legal documents, planning, and plans after approval; provide information, propaganda, dissemination, and education on laws on industry and trade; monitor the enforcement of laws on industry and trade.

        10. Assist the People's Committee of the commune in performing and taking responsibility for the appraisal, registration, and issuance of licenses within the scope of responsibility and authority of the specialized agency according to the provisions of law and according to the assignment, decentralization, or authorization of the People's Committee of the commune.

        11. Assist the People's Committee of the commune in state management of collective economic organizations, private economic organizations, associations and non-governmental organizations operating in the area in the field of industry and trade according to the provisions of law.

        12. Organize the application of scientific and technological advances; build information and storage systems to serve the state management of professional expertise of the Economic Department.

        13. Carry out information work, periodic and ad hoc reporting on the implementation of assigned tasks according to regulations of the Commune People's Committee and the Department of Industry and Trade.

        14. Monitor and inspect organizations and individuals in implementing legal regulations on industry and trade; receive citizens, resolve complaints and denunciations; prevent and combat corruption and waste according to legal regulations and assignments of the People's Committee of the commune.

        15. Manage and be responsible for finance and assets assigned according to the provisions of law and the management decentralization of the Commune People's Committee; assist the Commune People's Committee in managing market infrastructure assets according to the provisions of law.

        16. Perform other tasks and powers according to the decentralization, authorization, and division of authority of competent authorities as prescribed by law.

        17. Perform other tasks assigned by the People's Committee of the commune and as prescribed by law.

        Article 7.  Agriculture and Environment Sector

         1. Submit to the People's Committee of the commune draft resolutions of the People's Council of the commune, draft decisions, planning, long-term, medium-term, annual development plans and contents of tasks, programs, measures on Agriculture and Environment under the authority of the People's Committee of the commune according to regulations and other documents assigned by the People's Committee of the commune.

        2. Submit to the Chairman of the Commune People's Committee draft documents on the fields and specialties of Agriculture and Environment under the authority of the Chairman of the Commune People's Committee.

        3. Organize the implementation of legal documents, strategies, planning, plans, programs, projects, national standards, national technical regulations, specialized economic and technical norms after being approved by competent authorities; provide information, propagate, disseminate laws, and monitor law enforcement in areas within the assigned management scope.

        4. On cultivation and plant protection

         a) Advise and assist the People's Committee of the commune in performing the task of state management of crop cultivation and plant protection activities according to its authority; implement  management contents and measures in crop cultivation and plant protection activities in the area according to the provisions of law; announce epidemics and declare the end of plant pests in the area according to its authority;

        b) Advise and submit to the Chairman of the Commune People's Committee to mobilize local resources to implement epidemic prevention measures under the direction of the Chairman of the Provincial People's Committee; organize propaganda and dissemination of epidemic prevention measures in the area; implement policies to support epidemic prevention, overcome consequences caused by the epidemic, stabilize life and restore production in the area;

        c) Synthesize reports on epidemic prevention results and implementation of epidemic prevention support policies, overcoming consequences caused by the epidemic, stabilizing life and restoring production.

         5. About animal husbandry and veterinary medicine

         a) Advise and assist the People's Committee of the commune in organizing the management and development of livestock farming in the locality; organize the declaration of livestock farming activities, statistics on livestock farms, livestock households, and animal feed production facilities; make statistics, evaluate, and support losses for livestock farmers after terrestrial animal epidemics;

         b) Advise and assist the People's Committee of the commune in directing, organizing monitoring, forecasting, warning, announcing and ending terrestrial animal epidemics occurring in the commune; managing the activities of concentrated animal slaughterhouses; preliminary processing, processing, transportation, trading of animals, animal products and veterinary hygiene; supporting the arrangement of land funds to build livestock facilities for relocated subjects according to regulations;

        c) Advise and submit to the Chairman of the Commune People's Committee to submit to the Chairman of the Provincial People's Committee to decide on financial support, materials and resources when the request for animal disease prevention and control exceeds the local capacity;

         d) Advise and submit to the Chairman of the Commune People's Committee to allocate land, lease land, and create land funds according to authority to develop livestock farming and grow animal feed materials; announce epidemics and end terrestrial animal epidemics occurring within the commune according to regulations; implement policies to support the prevention and control of animal epidemics, overcome consequences caused by animal epidemics and restore livestock and aquaculture in the area; support costs of materials, training, vocational conversion training, technical training and equipment costs for service providers according to regulations;

         d) Advise on budget allocation and organization of prevention and control of terrestrial animal diseases; compile statistics, evaluate, and support damage to livestock breeders after terrestrial animal diseases.

         6. About forestry

         a) Advise and submit to the People's Committee of the commune to promulgate, according to its authority, or submit to competent authorities: programs and projects for sustainable forestry development in the locality; classify forests, demarcate boundaries of forest types; implement regulations on the responsibilities of the People's Committee of the commune and forest owners in forest management, protection, development and use, forest fire prevention and fighting in the locality;

         b) Advise and submit to the Chairman of the Commune People's Committee to decide on forest allocation, forest lease, forest type conversion; decide on changing forest use purposes to other purposes, forest recovery, land lease for production forest planting; alternative forest planting plan when changing forest use purposes to other purposes;

         c) Assist the Commune People's Committee in organizing the implementation of forest management and protection; forest investigation, forest inventory, monitoring forest developments; forest management, forest protection, conservation of resources and biodiversity in all types of forests; forest fire prevention and fighting; forest development and forest use; forestry programs and projects according to the decision of the Commune People's Committee; confirm dossiers of requests for forest allocation and forest lease according to the provisions of law.

        7. About seafood

          a) Advise and assist the People's Committee of the commune in performing the task of state management of fisheries according to the decentralization or authorization of the People's Committee of the provincial level; implement the contents and management measures in fisheries activities in the area according to the provisions of law;

          b) Assist the Chairman of the Commune People's Committee in performing the responsibility of coordinating with the provincial-level state management agency of fisheries in organizing the handling of endangered, precious and rare aquatic species that die without being kept, preserved, or processed into specimens for research, propaganda and education in accordance with customs and regulations of the law on veterinary medicine, environmental protection and animal and plant quarantine as prescribed.

         8. About irrigation

         a) Advise and assist the People's Committee of the commune in performing the task of state management of irrigation and rural clean water supply; organize the implementation of irrigation development plans according to the planning approved by competent authorities; direct the activities of organizations and individuals managing, exploiting and protecting irrigation works and rural clean water supply works in the area; organize the implementation of tasks of grassroots irrigation organizations in cases where grassroots irrigation organizations have not been established; mobilize local resources to organize handling when irrigation works have incidents according to the provisions of law; inspect the implementation of the contents of the license for activities within the protection area of ​​irrigation works; develop plans and carry out the dismantling or relocation of works according to regulations;

         b) Advise and assist the People's Committee of the commune in directing the activities of organizations and individuals in managing, exploiting and protecting irrigation works and rural clean water supply works; receive safety registration declarations for dams and small irrigation reservoirs in the area; give opinions on draft operating procedures for reservoirs in the area under the approval authority of the Provincial People's Committee according to regulations; organize to collect opinions from relevant organizations, individuals and experts on draft operating procedures in the commune; participate in the Advisory Council for assessing the safety of dams and reservoirs at the provincial level according to regulations;

         c) Advise and submit to the Chairman of the Commune People's Committee for approval and public announcement of the operation process of large and medium-sized irrigation works as decentralized by the Provincial People's Committee; approve and public announcement of the operation process of irrigation reservoirs in the area; approve the outline and results of safety inspection of dams and small irrigation reservoirs in the area according to regulations; approve the protection plan for dams and reservoirs in the area, the plan for placing boundary markers and the plan for protecting irrigation works in the area according to decentralized levels.

          9. On natural disaster prevention and control

         a) Advise and assist the People's Committee of the commune in developing and approving plans to respond to natural disasters in the area; organize the preparation of human resources, materials, means, equipment, necessities and organize drills according to the approved plan; inspect and urge the storage of food, necessities, water treatment chemicals, medicines, epidemic prevention, means, materials and equipment according to the four-on-the-spot principle to proactively respond when natural disasters occur; organize the management and distribution of emergency relief money and goods from the State, organizations and communities to stabilize life, restore production and overcome the consequences of natural disasters according to the provisions of law; decide on the use of land for a limited period in cases of emergency against floods, storms, and other natural disasters that require land use according to regulations; direct and organize the implementation of measures to protect production when natural disasters occur to reduce damage and quickly restore production; Construct, renovate, upgrade, manage and protect disaster prevention and control works in the area under management responsibility; organize the integration of disaster prevention and control contents into local socio-economic development planning and plans;

          b) Advise and submit to the Chairman of the Commune People's Committee to mobilize forces, materials, and means to overcome the consequences caused by floods, storms, and storms; allocate land and arrange accommodation for households that need to be relocated; decide to mobilize funds, forces, equipment, materials, related organizations and individuals and other resources for natural disaster response activities according to regulations;

         c) Advise and assist the People's Committee of the commune in organizing and commanding the work of responding to natural disasters; synthesizing, compiling statistics, and assessing damage caused by natural disasters; synthesizing and managing information and data on dikes, natural disaster prevention and control at the commune level; managing the implementation of planning according to the law on rural planning for rural residential areas, technical infrastructure works and production planning adapted to the characteristics of natural disasters in the area, ensuring sustainable development.

        10. About land

         a) Advise and assist the People's Committee of the commune in giving opinions on provincial-level land use planning; organize the establishment and adjustment of commune land use planning and 5-year commune land use plans; organize the implementation of local land use planning and plans; manage recovered land in rural areas; direct and organize the implementation of compensation, support and resettlement tasks; publicly announce commune-level land use planning and 5-year commune land use plans; manage and lease communal public land funds  and other tasks under the authority of the People's Committee of the commune;

         b) Advise and assist the Chairman of the Commune People's Committee in deciding on land recovery, deciding on compensation plans, resettlement support, deciding on specific land prices, deciding on resettlement housing prices, deciding on land allocation, land lease, allowing land use purpose conversion for individuals, deciding on land allocation for residential communities according to regulations within authority; deciding on land requisition, extending land requisition according to regulations and other tasks within the authority of the Chairman of the Commune People's Committee;

          c) Appraise dossiers on land allocation, land lease, land recovery, and change of land use purpose; check dossiers for granting certificates of land use rights and ownership of assets attached to land for the first time and advise the People's Committee of the commune to grant certificates of land use rights and ownership of assets attached to land to subjects under the authority of the People's Committee of the commune;

          d) Preside over the organization of determining specific land prices as the basis for calculating land use fees, land rents, compensation when the State reclaims land and other cases according to the provisions of law; organize appraisal of compensation, support and resettlement plans according to the provisions of law;

           d) Preside over and coordinate the implementation of state management tasks on land according to regulations.

          11. On water resources

           a) Advise and assist the People's Committee of the commune in organizing response to and overcoming water pollution incidents; monitor, detect and participate in solving water pollution incidents according to authority; organize the implementation of measures to prevent, combat and overcome harmful effects caused by water according to regulations; protect the quality of domestic water sources in the area; protect and prevent erosion of river beds, banks, lakes, and water source protection corridors; implement measures to monitor, supervise and protect water quality and domestic water sources in the locality; investigate, compile statistics, synthesize and classify wells that must be filled; review and make a list of organizations and individuals with underground water exploitation works, surface water exploitation and use works, dig lakes, ponds, rivers, streams, canals and ditches that must be declared and registered in the area; disseminate and propagate about water resources to raise awareness of water resource protection, economical and effective exploitation and use of water; inspect and handle violations of water resources laws in the area;

           b) Advise and assist the Commune People's Committee to periodically synthesize and report to the Provincial People's Committee on the exploitation of underground water by households for domestic use according to regulations; update data on registration of underground water exploitation in the area into the National Water Resources Information System and database;

           c) Advise and assist the People's Committee of the commune in coordinating with the Department: giving opinions on the establishment and adjustment of the List of water sources that must have protection corridors established in the area according to regulations; determining the boundary markers of water source protection corridors on cadastral maps and land use status maps according to regulations; establishing and announcing the List of lakes, ponds, lagoons and estuaries that cannot be filled in the province and giving opinions on the List according to regulations; approving the plan for placing boundary markers of water source protection corridors in the area; managing water source protection corridors; determining functional zoning for surface water sources within the province; determining and organizing the announcement of sanitary protection zones for domestic water intake areas; making plans for groundwater protection; artificially supplementing groundwater;

          d) Advise and assist the People's Committee of the commune in coordinating with the organization of management and operation of water reservoirs in the area: develop a plan to set up boundary markers for water source protection corridors of reservoirs according to regulations; carry out setting up boundary markers for water source protection corridors in the field; receive, manage and protect boundary markers for water source protection corridors according to assignment; supervise activities in water source protection corridors;

           d) Advise and assist the People's Committee of the commune in giving opinions on plans for marking boundary markers of water source protection corridors for dams and reservoirs; approval dossiers for prohibited and restricted areas for underground water exploitation and plans and roadmaps for organizing the implementation of prohibition and restriction of underground water exploitation according to regulations;

          e) Advise and assist the People's Committee of the commune in proposing and giving opinions on the adjustment of removing lakes, ponds, lagoons, and lagoons from the List of lakes, ponds, lagoons, and lagoons in the  province that cannot be filled according to regulations;

           g) Advise and submit to the Chairman of the Commune People's Committee to confirm registration for underground water exploitation; receive declarations for underground water registration; organize the determination of the boundaries of the sanitary protection zone of the domestic water intake area in the field according to authority;

          h) Advise and assist the People's Committee and the Chairman of the People's Committee of the commune in performing the responsibility of state management of water resources according to regulations.

         12. On geology and minerals

         a) Advise and assist the Chairman of the Commune People's Committee in issuing certificates of registration for mineral recovery according to regulations; organize the determination, submit to the Chairman of the Commune People's Committee for approval, adjustment, re-approval, and settlement of fees for granting mineral exploitation rights in cases of mineral recovery registration under the authority of the Chairman of the Commune People's Committee;

          b) Implement measures to protect mineral resources and the environment in mineral activities according to the provisions of law; ensure social order and safety in areas with minerals;

         c) Organize and mobilize local people not to illegally exploit, purchase, store, or transport minerals; detect and denounce acts of illegal mineral exploitation;

         d) Provide opinions on geological and mineral management plans, mineral exploration projects, mineral exploitation investment projects, environmental impact assessment reports and environmental licenses of mineral exploitation projects, mine closure projects in the area; participate in the Council for appraisal of the results of determining the cost of refunding mineral potential assessment, mineral exploration costs that must be refunded by the State's investment in the area; coordinate with the Department to hand over on-site boundary markers, area of ​​mineral activities according to the license and land lease decision to organizations and individuals licensed to operate minerals in the area; inspect and accept the implementation of environmental improvement and restoration;

         d) Develop plans and proactively arrange resources to implement mineral protection activities under local authority; carry out clearance and prevention of illegal mineral exploitation activities when detecting or receiving reports of illegal exploitation occurring in the area.

        13. About the environment

         a) Advise and assist the People's Committee of the commune in submitting to the People's Council of the same level to arrange funds to carry out environmental protection tasks according to current budget allocation regulations; report to the People's Council of the same level and the People's Committee of the province on environmental protection work in the area according to regulations;

         b) Submit to the People's Committee of the commune a list of industrial clusters without centralized wastewater collection, drainage and treatment systems in the area and report to the People's Committee of the province; synthesize budget needs for environmental protection activities in craft villages; environmental restoration plan, environmental incident response plan in the area and announce environmental incidents according to regulations;

         c) Advise and assist the People's Committee of the commune in directing and implementing environmental protection models for craft villages; invest in the construction and operation of solid waste collection and treatment models, and on-site wastewater treatment systems that meet environmental protection requirements invested by the State or contributed by organizations and individuals according to regulations;

         d) Advise and assist the People's Committee of the commune in managing production, business and service activities to ensure compliance with environmental protection regulations according to approved planning; manage waste collection and treatment at the commune level; invest in and upgrade drainage and wastewater treatment systems, collect and treat solid waste in rural areas; organize monitoring and assessment of environmental quality changes; delimit, treat, renovate, restore and improve environmental quality according to regulations;

         d) Advise and assist the People's Committee of the commune in organizing surveys and assessing the current environmental status and directing the implementation of environmental restoration plans for environmental incidents in the commune;

         e) Advise and assist the People's Committee of the commune in requesting compensation for environmental damage caused in the area under its management; request the People's Committee of the provincial level to organize the collection and appraisal of data and evidence to determine environmental damage caused by pollution and degradation according to regulations;

          g) Advise and assist the People's Committee of the commune in complying with the law on environmental protection in the process of resolving and handling investment procedures for new projects or projects in operation that increase capacity and generate wastewater in concentrated production, business and service areas and industrial clusters; guide and inspect investors in industrial cluster infrastructure business and owners of facilities in industrial clusters to fulfill their responsibilities for environmental protection according to regulations;

          h) Advise and assist the People's Committee of the commune in publicizing and informing the commune-level environmental incident response plan according to regulations;

         i) Advise and assist the Chairman of the Commune People's Committee in receiving environmental registration for projects and facilities according to regulations; direct incident response, mobilize forces, equipment and means to respond to environmental incidents and waste incidents; appoint commanders and spokespersons for environmental incidents and waste incidents at the commune level according to regulations; establish unannounced inspection teams and working groups to determine the causes of waste incidents at the commune level immediately after the incident occurs according to regulations; 

        k) Perform other environmental protection tasks as prescribed.

       14. On nature conservation and biodiversity

         a) Advise and assist the Chairman of the Commune People's Committee in deciding on self-defense plans to protect people's lives and limit damage to wild animals according to regulations;

         b) Implement nature conservation and biodiversity activities in the management area according to the provisions of law.

        15. About hydrometeorology

         a) Monitor compliance with laws on hydrometeorology by agencies, organizations and individuals in the area;

         b) Monitor, evaluate, exploit and use meteorological and hydrological forecasts and warnings to serve socio-economic development and natural disaster prevention and control in the area;

         c) Receive disaster warning and forecast information from the Provincial People's Committee and the Provincial Civil Defense Command;

        d) Participate in protecting hydrometeorological works in the area.

        16. Participate in developing and updating the province's action plan to respond to climate change; organize the implementation of the action plan to respond to climate change in the area; organize the implementation of programs, tasks and projects on climate change as assigned by the Provincial People's Committee and the Department.

         17. On measurement, maps and geographical information

          a) Conduct propaganda, dissemination, legal education, and monitor the enforcement of laws on measurement and mapping in the area;

          b) Conduct inspections, handle violations of the law, resolve complaints and denunciations regarding measurement and mapping according to authority;

          c) Participate in managing surveying landmarks according to the decentralization of the Provincial People's Committee and perform other state management tasks on surveying and mapping according to the decentralization or authorization of the superior state management agency.

18. Advise and assist the Commune People's Committee in performing the state management tasks of agricultural, forestry and fishery extension; quality, processing, food safety and market development of agricultural, forestry and fishery products; development of household economy, rural farm economy, collective economy, agriculture, forestry and fishery, mechanization, synchronous mechanization associated with rural occupations and craft villages.  Manage projects for agricultural, forestry and fishery development, irrigation works, natural disaster prevention and control and rural development in the commune according to regulations.

          19. Perform the task of advising on the organization and implementation of the National Target Program on New Rural Development and the National Target Program on Sustainable Poverty Reduction in the commune; preside over the organization, implementation, monitoring, synthesis, and reporting of implementation results; coordinate with organizations, unions, and communities to implement the contents of the programs according to regulations; develop the rural economy associated with OCOP products and develop rural tourism.

20. Assist the People's Committee of the commune in performing and taking responsibility for the appraisal, registration, issuance and revocation of licenses, certificates and other equivalent documents within the scope of responsibility and authority of the specialized agency according to the provisions of law and the assignment of the People's Committee of the commune.

21. Assist the People's Committee of the commune in state management of collective economic organizations, private economic organizations, associations and non-governmental organizations operating in the area under the management of specialized agencies according to the provisions of law.

22. Inspect the implementation of legal regulations on Agriculture and Environment for organizations and individuals in the management area; resolve complaints and denunciations; prevent and combat corruption, waste and negativity according to the provisions of law and the assignment of the People's Committee of the commune.

23. Conduct research, apply science and technology, innovate; apply information technology, digital transformation, deploy e-Government, towards digital Government, digital economy, digital society, digital countryside, digital farmers on agriculture and environment; participate in building, managing, updating and regularly using databases; statistical work, providing, storing data and information on Agriculture and Environment according to the provisions of law and as assigned by the People's Committee of the commune.

24. Carry out information work, periodically and suddenly report on the implementation of assigned tasks in the fields of Agriculture and Environment according to the regulations of the Commune People's Committee and the Department.

25. Manage the organizational structure, civil servant payroll, civil servant ranks and civil servant ranks, job positions, staff structure according to professional titles and the number of employees in public service units; implement salary regimes and policies, treatment regimes, training, fostering, rewards, and discipline for civil servants, public employees and workers under the scope of management according to the provisions of law, according to the assignment of the People's Committee of the commune.

26. Perform other tasks and powers according to the decentralization, authorization, and division of authority of competent authorities as prescribed by law.

27. Perform other tasks assigned by the People's Committee of the commune, the Chairman of the People's Committee of the commune and in accordance with the provisions of law.

29. Other tasks

a) Assist the People's Committee of the commune in organizing training, fostering, guiding and inspecting professional and technical matters in the field of state management of agriculture and environment for civil servants and related organizations and individuals according to the provisions of law.

b) Assist the People's Committee of the commune in organizing and operating associations and non-governmental organizations in the management field under the authority of the commune.

c) Conduct research, apply science and technology; deploy e-Government, digital transformation towards digital Government on agriculture and environment; build, manage, operate and provide data, information and documents on management fields according to the provisions of law and as assigned by the People's Committee of the commune.

d) Carry out information work, periodically and suddenly report on the implementation of assigned tasks to the People's Council, People's Committee of the commune and superior state agencies.

          d) Manage and be responsible for the department's finances and assets according to the provisions of law.

e) Manage and use civil servants according to job positions, implement regimes, policies, incentives, rewards, discipline, training and professional development for cadres, civil servants, public employees and workers under the management department according to regulations of law and assignment of the People's Committee of the commune.

f) Perform other tasks as prescribed by law and as assigned, delegated or authorized by the People's Committee of the commune, the Chairman of the People's Committee of the commune and superior state agencies.
